Personal Injury

Personal injury is a general term used by lawyers to describe a wide array of cases which involve the physical injury of an individual due to the fault of another individual or company. Unfortunately for the consumer, lawyers have done a lousy job of educating the public as to the instances which may give way to a recovery of money damages in particular instances. The survey below is by no way exhaustive, but lists common instances where personal injury cases may arise. If you or a family member has been injured due to the acts of another individual or business call the Law Offices of Benjamin F. Goodwin, Esquire, today at (724) 438-1616 or (724) 966-9090 for a free, no pressure, no obligation consultation regarding your rights.  You have nothing to lose but your legal troubles.

Dog Bites & Animal Attacks

Attacks by dogs or other animals can happen anywhere and at any time with little to no warning. Pennsylvania law provides that an owner or handler of a dog or other animal has a duty to warn or protect visitors or passersby’s from that animal, if the owner has knowledge that the dog or animal has displayed aggressive behavior in the past such as snapping or biting a person. Unfortunately, children are most often the victim of animal attacks and bites due to their proximity to the ground. Likewise, children are more likely to be attracted to the animal, and less able to defend themselves from the animal.

Animal or dog bites or attacks can leave you or a loved one with permanent scars or disfigurement, nerve damages, broken bones, serious emotional distress and psychological damage, infections, and even death. Dog bites or animal attacks can occur in residential neighborhoods, at businesses, parks, walking trails and anywhere dogs may be found. Animal or dog bites or attacks can occur as a result of the owner’s failure to keep the dog properly leashed, caged, or otherwise restrained.

If you or your child has been injured as the result of animal or dog bite or attack call the Law Offices of Benjamin F. Goodwin, Esquire, today at (724) 438-1616 or (724) 966-9090 for a free, no pressure, no obligation consultation regarding your rights.  You have nothing to lose but your legal troubles.

Inadequate Security

Inadequate security cases typically arise when the owner of a business, typically a tavern or restaurant, fails to take adequate steps to provide security and protection to their clientele and patrons from that business’s employees or from other patrons when they know or should know that a fight or an assault is about to occur. Put another way, owners of businesses cannot sit idly by when they know that criminal activity such as robberies, assaults, thefts, or rapes have occurred in their establishments in the past. Owners of businesses have a duty to warn and protect their clients and customers from the unlawful acts of others. Unfortunately, innocent customers at bars, restaurants, parking garages, schools, stores, malls, or other establishments can quickly become the victims of a crime through no fault of their own. When this happens and the owner of the business knew or should have known from past experience that such criminal activity had occurred and the owner fails to take reasonable steps to protect their customers from the criminal activity, the business may be liable for any injuries suffered by the victim.

If you were the victim of a crime or assault while you were a patron at a business, call the Law Offices of Benjamin F. Goodwin, Esquire, at (724) 438-1616 or (724) 966-9090 for a free, no pressure, no obligation consultation regarding your rights.

Premises Liability

This phrase is often used to refer to cases where a dangerous condition or hazard on the land or property of another causes an individual to suffer an injury. The land may be that of another individual, hotel, inn, restaurant or other business. The list of ‘dangerous conditions’ is almost infinite. They include, but are in no way limited to:

  • Broken or loose steps

  • Broken or loose hand rails

  • Broken or loose floor boards

  • Weak flooring

  • Inadequate lighting

  • Exposed electrical wires

  • Unsecured shelving

  • Missing tiles

  • Holes in flooring or ground

  • Sharp edges

  • Exposed spikes and nails

  • Tripping hazards such as uneven carpets, floors, mats, or linoleum

  • Balcony collapses

  • Roof collapses

  • Slippery surfaces

If you or a loved one has been injured as the result of coming into contact with a defective condition on the property of another individual or business call the Law Offices of Benjamin F. Goodwin, Esquire, today at (724) 966-9090 or (724) 438-1616 for a free, no pressure, no obligation consultation regarding your rights.

Products Liability

“Products Liability” cases involve injuries caused by defective products such as automobiles, all terrain vehicles, household appliances, tools, toys, machinery, food, defective medical devices, medication, or other consumer goods.

Generally speaking, in order to succeed in a “Products Liability” case, the injured party must prove that: (1) the product was defective; (2) that the defect existed when it left the hands of the defendant; and (3) that the defect caused the harm. The defect may be in the form of a design defect, manufacturing defect, or defective warning. Additionally, a product liability case may be brought by an injured party on the basis that a product did not live up to an express or implied warranty.

If you or a loved one has been injured as a result of using a product, whether at work at home or while driving, the first thing you should do is to save the complained of  product and call the Law Offices of Benjamin F. Goodwin, Esquire, at (724) 438-1616 or (724) 966-9090 for a free no obligation consultation.

Trip & Fall, Slip & Fall

Whether you are going to the grocery store, the mall, your salon, or just visiting a friend at their house, an owner and occupier of real estate owes you a duty to make sure that the area in which you are walking is free of tripping hazards and or substances which you may not have been able to detect or avoid.  Spilt slippery substances, snow and/or ice accumulation, broken or loose steps or hand rails, uneven floors, slick surfaces, and unsecured or bunched mats, can all trigger individuals to lose their balance and fall causing serious injuries and upheavals in their life.
If you have tripped, slipped, or fallen at a business or at the residence of another and think you may have a case, call the Law Offices of Benjamin F. Goodwin at (724) 438-1616 or (724) 966-9090 for a free no obligation evaluation of your claim.
